Is this guy using a throttle?

Before January 1, 2016, bikes sold with trottles could legally propel up to 15.5mph without pedaling. However, due to their 250 watt motors, still required some pedaling to ascend steep hills. When the new law came into effect, limiting throttle operation, it did not prevent the use of bike stocked and sold before January 1, 2016. In fact, there were still full throttled 2015 models sold into 2016. When they were gone, they were gone.

Pre 2016 bikes can still be used and sold used with full throttle operation. I know this may not make sense but it is what it is. All new bikes fitted with throttles can achieve 15.5mph on the throttle just as long as the pedals are turning. You can be in low assist, first gear, pedalling slowly and putting no effort in to have the throttle work up to the legal maximum speed. Hope this helps.
