As far as I am aware, it is up to the prosecution to prove its case. Courts cannot draw any inference from silence.

The MET Police only cover London, and in any case, Police cannot give legal advice, just give a lay person's opinion as to the law. My guess is that the Police see advantages in people wearing these and in London and Scotland do not intend to interfere.

I think that it is an offence to wear something closely resembling Police uniform.
