Bike Europe announces that Dutch manufacturer Sparta are introducing a new budget e-bike called the e-motion, immediately bringing confusion with Spanish manufacturer BH with their E-motion range.

There's also two different Chinese made e-bikes on sale in the USA, both called e-motion, and 50cycles sell a range of Casco helmets called E.motion.

A pity they can't all keep their emotions under control and spend time thinking up some original names.

Can the first person to use the name e-motion stop others using it?

I rather doubt it Conal, there's always a problem when an ordinary word in the language is used, though the use of dash and full stop separators might just do the trick.

Even the mighty Microsoft failed to obtain the word windows as copyright and probably only got the capitalised version Windows registered by throwing around their weight. It didn't afford much protection though, since their attempt to stop rival OS Lindows from using that similar name failed in the USA and Britain. It was only when they took the cases to non-English speaking countries where Lindows was selling that they won, since windows is not a word in those other languages and Lindows could be ruled to be copying a trade name.

Very difficult though, the e-motions in the USA are names given by dealers/importers to Chinese bikes they bring in so aren't truly brands, so to protect the name is probably a never ending fight not worth the effort.
