Unless it detects acceleration but that would not work on hills as you are usually only maintaining or losing speed.

Yes it is in respect of the quoted subject. Brake cutouts are not necessary or required under EU law, and most e-bikes made in the EU and for the EU don't have them, the pedelec control is considered adequate.so not UK or EU legal then!!
