Yes you probably have the throttle parameter set for pedal first then throttle is active. P4 setting needs to be value 0. C4 value 0 or 2 where you can set a speed limit for it.

Weaker cells/ groups will bleed back a little or maybe the BMS only allowing 95% charge and bleeding cells back. Only Bosch/Dealer can test load the battery for you, as long as it remains at 95% then not a lot to worry about.
