    Brexit, for once some facts.

My thought is that this depends on the majority of member countries. If enough want change it will happen, and there are signs that quite a few are disatisfied with certain aspects. But change is unlikely to be initiated by the EU Commission. Sadly yes, it's in the nature of our first past...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

Obviously this will be widely ignored and many throttles fitted with no-one trying to prosecute, that's always been the case with pedelec law. Technically a successful prosecution is certainly possible since a law is being broken, but no-one will ever bother, it's too much trouble for a...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

It's as I've repeatedly explained Craiggor, manufacturer built EAPCs cannot have an independent throttle, since their exemption from type approval prevents one being fitted. Since neither the EU or the British have legislated on self builds, they can get away with having one. They do not need...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

It's just extending what has always applied to motor vehicles, only OEM parts should be used. But that's been widely ignored so the same will happen with pedelecs. .

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

Technically yes, but this strict interpretation on requiring genuine original replacement parts is widely ignored. It's mainly in cars etc when accidents occur that involve the failure of non-standard parts that it can get serious. .

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

I would think a strict interpretation is that if a third party throttle is used, SVA would be necessary since the part is not what has been type approved. If the original part that the maker used on type approved models is used, no, since it complies with the type approval specification. .

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

No, because it's not a usage law as far as I can see, it's a law applying to manufactured pedelecs as supplied. It was originally only a German law and applied there to all bicycles. I've extracted this part from a translation of German law: Equipment on Bicycles sold as new, each bicycle...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

It's not seen as a new class, the DfT say that throttle pedelecs are still considered to be EAPCs. .

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

For a manufactured pedelec I would say yes, since it only gained approval for road use without type approval by compliance with the the exemption. So post fitting a throttle is avoidance unless SVA is sought to approve it. .

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

That's because the manufactured EAPC only escaped being type approved as a motor vehicle because it fully complied with the 168/2013 exemption (h). Post conversion into non-compliance nullifies the exemption and would be seen as a deliberate attempt to avoid the law. Since a converted bicycle...

Pedelecs frum makes me feel sick

Hi Russ In a conversation with John something occurred which made it look to both of us that it could only have happened in response to something just posted within the conversation. That was the source of this thought. It seems that it was a very remarkable coincidence from what you've said...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

That's correct, type approval had never applied to individual builds or grey imports. For them Single Vehicle Approval exists. But there is nothing in 168/2013 about self builds, it's legislation for manufacturers only, so self builds fall outside of it's remit and can exist in a loophole...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

No, the pedelec usage law still applies with respect to maximum power and assist speed limit.. The throttle is only by the default of the Type Approval loophole. .

    Brexit, for once some facts.

You're right it is a mess, and one that could get worse. There are some fundamantal problems with this referendum and the way it's shaping up as a close decision. This is mainly due to the very high proportion of undecideds, inevitable in such a complex issue in which adequate facts about...

    Brexit, for once some facts.

Steady up guys, lets not get too personal. I think the newspaper view is that it's most likely to be the young not registered, so getting more included increases their number. Since the young are thought to be more pro-remain, they see that as a remain fiddle. However, even if it is, it's...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

I rather doubt it because it's a supply law for manufacturers selling into the EU, their pedelecs having to be equipped witn automatic lights. There isn't such a law for self builds, basically there's no law allowing self builds but no law preventing them, so they can exist through a loophole in...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

The DfT has made a statement, effectively saying that conversions with throttles have no law preventing them fitting into the existing UK EAPC law. No legislation needs to be passed to make their throttles legal since there's nothing in law to say they are illegal. In effect for self builds...

News - DfT: Pedal cycles converted to ‘twist and go’ exempt from type approval

The lighting rule applies only on type approved pedelecs, since the conversions avoid the law by being outside it. It is unfair as you say, but just an accident of fate. .
